The legal contract between the HostFirst and the users is what we call terms of service or the terms simply. They explain how you are free to use our services through our website and platform. Also, it tackles all of the associated internet and online properties and software that we provide to use or download. Moreover, they govern all the data, text, graphics, information, proprietary content, software, and many more on our site. Overall, the materials, the site, and services we provide as called "Services."
Using our services declares that you read and accept the Terms. If you disagree, HostFirst is not for you.
Using our services, you warrant and represent that you are of age under the laws of your jurisdiction and can enter into contracts legally. If not, you may not use the Services in any manner or submit any information to HostFirst.
Suppose you are entering into these Terms on behalf of a business entity or organization. In that case, you represent and warrant that you have the legal authority and capacity to bind such a business entity or organization. If you are not deemed nor authorized by law to have this authority, you assume personal liability for obligations set out in these Terms of services.
These Terms: HostFirst has the liberty to update, change, add or remove provisions by posting the updated Terms and by providing a notice on the Services. We will ask for consent to the updated Terms, and our notice to you will explain how you can accept or reject the changes. If you disagree with the updated Terms, you must stop using them. Unless otherwise required by law, the updated Terms of Service are practical as of the day of posting.
The Services: HostFirst can alter the Services at any time without notifying. In case of objection to any changes, you are only left with the choice to cease using the Services. Continued use will indicate your acknowledgment of satisfaction with the Services as modified. We also have the right to discontinue the entire Services or any component. We are all free to discontinue or modify our services, and no third party can order us to do so.
Paid subscriptions: If you fall under paid-subscription services and can change the pricing, we will notify you. And, changes will become effective after your then-current subscription terminates. If you disagree, communicate this to us according to the notification. We will not renew your subscription automatically, even if you previously agreed to the automatic renewal.
Visitors: Visitors can browse the site according to these Terms but can not be fully accessible to the Services without becoming a "Registered User."

Account Management: To register for the Services, the user will select a login email and password. You can use the Services or modify the content and data only through this login and password. Users are responsible for maintaining the confidentiality of Their passwords and other activities under your Account. HostFirst reserves all the right to formulate an account verification process to verify the account and any information provided. Also, it is your responsibility to ensure that our domains are not included in the spam block list used by the mail provider you use. You need to perform all necessary management tasks and security configuration for your sites and domains, web pages, and IP addresses hosting through our Services. You have the right to manage updates, security patches, and files accessible to any application software installed via your sites.
Subscriptions: At the time of registration, users choose from the list of available Services the service plans they wish to subscribe to. Subscription to the Services will be deemed accepted by HostFirst when it delivers a confirmation of the subscription. HostFirst has the right to refuse to provide any Service. Notwithstanding Our Uptime Guarantee, HostFirst also has the right to interrupt user access to the Services to perform regular or emergency maintenance as needed.
Subscription begins upon confirmation and receipt of lawful funds. The length of the initial subscription term is chosen by users and indicates when You subscribe to Our Services. Users may not cancel the subscription during the Initial Term except in the event of a breach by HostFirst.
Pricing: HostFirst has the right to modify the pricing plan for paid Subscriptions and does not provide refunds or price protection in the event of price decreases or promotions. Such changes will become effective after your then-current subscription terminates. Suppose HostFirst agrees to provide Services in the future after the subscription ends for some reason. In that case, the paid amount under any period is not determinant of the amount. You will pay to get our services again. So, It is up to you to check Our Site for pricing plans or changes to take advantage of changes that may have occurred. HostFirst does not update Your Subscription plan automatically. All up or downgrades are performed at users' request and may include modification of Fees or require re-initiating service with HostFirst.
Cancellation Terms: You have full liberty to cancel your subscription whenever you want, and such cancellation becomes effective upon the expiry of the subscription term. Subscription fees will not be refunded in any way subject to applicable law. Also, you will not be eligible for a pro-rated refund of the Subscription fees paid for unused days of the then-current Subscription Term.
Cancellation of any Service before the expiry of the prepaid Fees, You agree that HostFirst may not issue any refund at its sole discretion. Such fees may include set up Fees, any remaining prepaid Fees, and special programming Fees.
If you purchase the Services that we offer for a free, either Subscription basis or one-time basis, you consent to the use of third-party payment providers for processing and billing online payments. Also, it declares you to agree to pay the applicable fees for Services as they become due. To add more, you must pay all related taxes and reimburse for all collection interest and costs for any overdue amounts. The recurring and initial fees for the selected services shall be provided in an initial online order. All special programming fees and set-up fees are non-refundable. Otherwise, we may invoice Fees in advance—failure to pay fees when due may result in the termination or suspension of Services.
Users must pay fees till the end of the Subscription Term. Remember, our Subscriptions may be subject to some usage limits. If we find that Usage exceeds the actual usage limits purchased in a routine verification process, we have the right to invoice you for the additional use. Also, we can contact you to discuss the currently purchased plan and other available options. You can upgrade to an upper usage plan if necessary. If you fail to pay on time or if we cannot charge the payment method, HostFirst can suspend or terminate the subscription and Access to the Services.
HostFirst can terminate the subscription at its sole discretion for any reason or no reason. In such a case, HostFirst will provide users with thirty days' written notice before taking the final step. If HostFirst cancels a subscription according to any terms outlined in these Terms, except Termination without Cause, HostFirst will refund any fees paid of such cancellation. And you will be obligated to pay the fees before cancellation. In case of termination, all prepaid payments will be forfeited and not refundable.
HostFirst can terminate your subscription immediately if it determines You or any end-users:
(i)have breached the Acceptable Use Policy (AUP)
(ii)have violated or infringed any intellectual property privacy or right or publicity right of a third party
(iii)have not complied with applicable law, regulation, statute
(iv)have published, uploaded, or disseminated any text, images, code, graphics, or video can be illegal or high risk, in its discretion
(v)have breached these Terms.
Nothing contained in these Terms is intended to impose an obligation and duty upon HostFirst to review or monitor Your Content or the content of Your end-users at any time.
If any party terminates or cancels your subscription for some reason, You will be solely responsible for making necessary arrangements to secure a replacement service provider. It will also help you move all electronic data, video images, graphics, or text to the new service provider.
Users are responsible for what end users do. Users post, submit, upload, store, or make available on other sites, host their text, comments, Apps, audiovisual works, photographs, graphics, information, messages, animation, opinions, motion pictures, videos, sounds, music, software, and any other content. You can not Make Available any material protected by trademark, copyright, or another proprietary right without the express permission of the owner of such trademark copyright or proprietary right by a third party. And, the burden of determining such a right protects any material is on you.
You can be solely liable for damage resulting from any infringement of trademarks, copyrights, proprietary rights, privacy violation of contract, publicity rights, or other harm that you make or submit. You own user Content between you and HostFirst. And, you will be responsible for User Content, including its reliability, legality, and appropriateness of using the Services.
HostFirst does not actively monitor content hosted by HostFirst, at its sole discretion. It may elect to monitor its network electronically. And, it can disclose any records or content concerning Your Account to satisfy any regulation, law, or other governmental request or to operate the network and protect any customers.
HostFirst will actively investigate complaints of third-party rights violations or the Acceptable Usage Policy. It will cooperate with those who attempt to lessen Internet abuse. In this way, it has the right to institute "filters" or other mechanisms for that purpose. You expressly agree and acknowledge that HostFirst will not be liable to users or end-users for HostFirst's actions to restrict or remove Access to services alleged violation of AUP.
Back up: You agree that you use the Services of HostFirst at Your own risk. And, the HostFirst is not liable for data loss with its Services. You are responsible for creating backups of user Content. We highly recommend You establish a backup procedure. Also, it would be best to periodically test the restoring files from backup media to ensure viable backups. If you wish for HostFirst to provide services provided under these terms and backup services, you are all free to contact us.
Resource Usage: HostFirst owns the right to disable accounts or suspend service if the Account unduly stresses system resources. You will be notified of the temporary block to the point of degrading overall performance.
Security: Violation of security is prohibited and may result in civil and criminal liability. Unauthorized Access of the servers to provide the Services is not permitted and violates the AUP and Terms. You disagree with engaging in such an activity or trying to breach the Services by manipulating or altering the software or hardware, compromising the Services. And for any other unauthorized action commonly known as "hacking." To add more, violation of these security provisions may be grounds for Termination for Cause of user account as per these Terms at Our sole discretion.
